Illinois Supreme Court Announces New Public Domain Citation System

The Supreme Court of Illinois has announced a new public domain citation system — see the online Illinois State Bar Association (ISBA) story:

The new method eliminates the need to contract with publishers to have official opinions produced in bound volumes (which must then be purchased), reportedly saving Illinois taxpayers hundreds of thousands of dollars a year.

As stated in the ISBA story:

The public domain citation system was first recommended by the American Association of Law Libraries in 1994 and was endorsed by the American Bar Association in 1995. Since then, about a dozen states have adopted it.

First Peter gives a well-deserved “e-high five to Erika Wayne” (read his post for the reason) and then concludes his blog posting thusly:

Last of all, I cannot restrain myself from praising our extraordinary librarians at Stanford Law School. I have a bucketful of examples of their extraordinary sleuthing (the Martin speech is only the latest), one of which includes going through repeated FOIA requests and appeals, losing each one, and then still securing the key document from an 80 year old researcher who had it in his own files in some barn in Vermont, or something like that. I only know SLS, so if you have other examples of librarian sleuthing that made your research possible, I’d love to hear them, as I think they are the sometimes too-well-kept secret of the academy. After all, an eminent legal authority — I think it was Ronald Coase, but it may have been Moses himself — once said that every great scholar needs a good tailor, a good priest, and a good librarian. I have no experience with the first two, but can vouch emphatically for the third.

 

SCOCAL in the news and its recent growth spurt (with a new feature in development too).

Our Supreme Court of California Resources  database  (SCOCAL) is in the news!  There is an item about the project on page 2 of the  Stanford Lawyer just-out Spring 2011 issue (Volume 45, Issue #2), “California Supreme Court Opinions and Annotations Online.” 

We have 67 students in our Advanced Legal Research class this spring (67!) and they each have to write two annotations.  The first is due today, so 67 new annotations will be appearing online before (or perhaps at) the first stroke of midnight.

Later this summer, in partnership with a law firm, we will be adding a new feature to the database, so please stay tuned.

Article on Blogging by Chinese Judges

Professor Anne Sy Cheung’s article in the Harvard International Law Journal includes a couple of interesting findings that merit further investigation.

On page 267 of the article, Prof. Sy Cheung writes:
“While Blogging by judges may be an unusual phenomenon in common law countries, it is not unusual in China. In fact, more than half of the bloggers in this study wrote in their real names.”

Table 1 of the article breaks down the content of blog postings by Chinese judges.  Nearly 34% of the blog postings related to legal research.

Appendix IV lists the most common legal research question asked by the judges:

1. Copies of laws, regulations, and rules as well as comments on them.
2. Comments and opinions on draft legislation.
3. Criticizing the Rules of Payment of Court Fees issued by the State Council in December 2006.
4. Researches on a broad range of topics, such as compensations for damages to person happened in schools, the principle of innocence, problems of the Property Law of the PRC, role of the procuratorate, land system and land reform, citizens’ rights and freedom, real estate development and house transactions, labor disputes including payment of wages and salaries, and compensation for damages to accidents at work, and introduction of the spiritual compensation to civil suits collateral to criminal proceedings (some of these researches have been published in journals by the writer, blog owner).
5. Discussions on the tradition of Chinese culture and law.
6. Copies of court decisions that have come to effect.
7. Judicial interpretations issued by the Supreme People’s Court.
8. Routine work of the courts.
9. Introduction of Western legal theory, thought, and practice.

G-20 Materials

Each G-20 meeting has created its own Web site of documents, with varying degrees of comprehensiveness.  No central repository exists of G-20 documentation, but some recent initiatives might help.

Bloomberg Law has started a G-20 Declarations library under the “Global Law” tab.  It includes declarations from the G-20 summits since 2008.

The Journal of Law – “Like Water for Law Reviews”

Another Volume #1, Issue #1, just came across my desk:  The Journal of Law.

The Journal of Law looks like a conventional law review, but it is really a bundle of small, unconventional law journals, all published together in one volume.  This approach saves money over separate publications.  It also frees editors of the individual journals to spend more time finding and refining good material . . .  The idea is that the Journal of Law will be an incubator of sorts, providing for legal intellectuals something akin to what business schools’ incubators offer commercial entrepreneurs: friendly, small-scale, in-kind support for promising, unconventional ideas for which (a) there might be a market, but (b) there is not yet backing among established, deep-pocketed powers-that-be.

This first issue contains three journals:

Pub. L. Misc. is a project of James C. Ho of Gibson, Dunn & Crutcher and Trevor W. Morrison of the Columbia University School of Law.  Their plan is to provide a forum for the publication of a relatively neglected body of legal material: constitutional documents, recent and ancient, that originate outside of Article III of the U.S. Constitution.

Law & Commentary is an experiment in non-blind peer review in which signed reviews (by senior, influential scholars) are published side-by-side with the reviewed work.  The first issue features an article by Stuart Chinn of the University of Oregon School of Law, with commentary by Bruce Ackerman of the Yale Law School and Sanford Levinson of the University of Texas School of Law.

The Congressional Record, FantasyLaw Edition, is a student-edited journal . . . focusing on empirical analysis of the activities of federal legislators.

It’s in print too and will be “as long as the most prestigious law reviews appear in print, . . . “  As for when it will “abandon ink and paper” it cites, among other things, the Durham Statement.

Hip High Hires Hein

Mainly for its debate team – see below.

There are numerous ways to keep up with developments in legal bibliography and legal research.  Blogs bring lots of news about legal research plus more.  Twitter is great for breaking developments and news (some of my favorites here include @aabibliographer, @EJWalters, @glambert, @jasnwilsn, and the amazingly good @lawlib).  Visiting the vendor booths and demonstrations at the conference exhibit hall, while one of my very least-favorite things to do, is also useful for learning the latest and greatest. 

But there’s no substitute for face-to-face meetings with vendor representatives.  Here at Stanford we always look forward to our more-or-less annual visit from Steve Roses, our HeinOnline representative.  Steve is personable, highly intelligent, and shares his passion for his products with us — he’s less a salesperson and more a partner in our research efforts.  And we always learn something new.  During Steve’s last visit  here, while we were chatting about this and that, Steve mentioned that Hein had just acquired its first high school customer, a high school in Texas.  I found that tidbit intriguing and shared it with my class; one of the students later e-mailed me a note, “I have a friend who went to [that high school*].  It’s a very achievement oriented high school!”

I shared that information with Steve and he recently wrote to me that Hein now has its second high school customer:  Loyola High School in Los Angeles.

The school’s library director, April Hannah, reports that the school acquired the database primarily for its debate team and she is delighted that she can provide an affordable legal database to the team and its coaches (they just can’t afford LexisNexis she wrote in an e-mail).

I’m really impressed.  How many times have we reference librarians received a request from a patron who was looking for a certain law review article and threw up their hands saying “I couldn’t find it in Lexis or Westlaw.”  So many students find LexisNexis and Westlaw to be the be-all and end-all for, well, everything.  It’s always a pleasant revelation when we show the students (and faculty) how they can locate secondary sources plus a huge corpus of law review content, read compiled legislative histories, find the Federal Register going back to the beginning of time, plus lots more, and all without worrying, or even thinking about, search charges.

And I just can’t wait until the kids from Loyola High School make their way to law school!

The Existential Exercise of Finding State Court Materials Online

Recently, we’ve had the opportunity to explore the online availability of state superior court filings, both through commercial retrieval services (such as Lexis’ CourtLink or Westlaw’s CourtExpress), and the superior courts’ own websites.  Sites like Justia are also incredible resources for obtaining select trial court documents, but our project instead examined more standardized provision of dockets and filings.

Having wrapped up this undertaking, we thought it would be useful to share our reflections.  First, a quick caveat about what this project did not involve. We were not comprehensively indexing document availability in every U.S. county, or even in all fifty states.  Rather, we examined selected states and counties, based mainly on population size.  In addition, though we are aware of various existing studies and compilations documenting the availability of state court records, we wanted to look behind some of these reports.  As we often found, a commercial retrieval service’s representation that the “civil filings are available” did not mean all filings on all matters.  Moreover, in a world of ever-changing court websites and eFiling programs, existing studies unfortunately have a somewhat limited shelf life.

So, with those disclaimers in mind, we are excited to share how floored we were by the disparities in the online provision of state court dockets and pleadings!  Here are a couple of observations:

I.          Commercial Services (e.g. CourtLink and CourtExpress)

  • Sometimes, one can get little for one’s money.  The commercial services’ promotional materials are sometimes misleading if you want to retrieve filings.  For instance, their coverage charts could indicate that dockets from Shawnee County, Kansas are available, but one can’t actually retrieve the dockets online; they are “available” only in the sense that one can make a request online (and pay additional money) to have a runner pull them from the court.
  • Another drawback was the infrequency with which commercial services updated their state trial court dockets.  Even if one clicks a button to manually update a docket, this does nothing if one is attempting to do so within the long stretches between docket captures.  (Commercial services capture docket snapshots only every 45 or 60 days, meaning that even if one tries updating in an intervening period, one really isn’t getting any newly-added information.)
  • We also found that, while commercial services often capture federal dockets and filings from PACER indiscriminately, their state court coverage is extraordinarily selective.  They often choose cases based on subject matter cachet, or the perceived needs of their customers.  If you want documents from a run-of-the-mill breach of contract case, you might be out of luck.
  • Don’t try this at home if you want to conduct empirical analysis!  What isn’t available through commercial services significantly constrains research, but what hinders research even further is the inability to determine what isn’t available. How can one properly evaluate, for example, filings in a given jurisdiction when it is unclear what hasn’t been made available for searching?

II.        Publicly-Available Court Websites

  • A trial court’s offering of documents online is not necessarily a question of whether the court sits in a county wealthy enough to provide them.  For example, the superior court in Cincinnati, OH (sitting in Hamilton County) offers document access online, but San Diego County does not.  And one can view civil dockets from Dallas, TX, but not from Denver, CO.  There seems to be something other than wealth or the political inclinations of the jurisdiction at play.  Perhaps it is a matter of prioritization by the state legislature or judiciary, or maybe even the serendipity of having companies nearby that can get databases up and running.  Certainly, jurisdictions with well-established eFiling programs have a leg up on putting documents online; but, even in jurisdictions with eFiling in place, it is not always the case that dockets—let alone documents—can be retrieved on the Web!
  • The quality of available dockets varies dramatically because state court clerks exercise no uniformity in document description.  It is difficult to compile a collection of complaints if various clerks label documents “pleading” or “misc. filing.”
  • Navigational problems can leave you lost at sea.  We spent a lot of time fumbling our way around some of these sites.  One wonders if it is truly “access” to records if one needs a vacation after trying to find them.

At the end of the day, we found too many gaps in coverage for anything to be considered “consistently” available online.  One first step in measuring the parameters of these disparities would seem to be a county-by-county analysis of which trial courts in which states provide online access to dockets and/or filings—either through commercial services or their public websites.  Surveys like the McCormick Tribune Foundation’s comprehensive 2007 assessment, or the commercial services’ coverage charts, are great first steps—but additional testing is required, particularly to keep such studies current.

How widespread is WestlawNext?

A student asked me this question.  Since I live and work in the beautiful bubble known as Stanford University,and have no idea how things work in the Real World, I turned to outside help to answer the student’s question.

I first asked our Westlaw representative, who provided this interesting and useful piece of information:

Based on a recent article about Thomson Reuters revenue, “The WestlawNext legal database has been sold to more than 18,500 customers since its launch in February 2010, representing 34 percent of Westlaw’s revenue base.”

But I knew that our students would want to know more specific information, so I sent out a quick request on the Northern California Association of Law Libraries (NOCALL) listserv.  I received 21 replies — 6 from Biglaw law firms, 8 from small/midsize firms, 2 from county law libraries, 4 from the courts (U.S. District, United States Court of Appeals and California Appellate), and 1 from a state agency.  Of the 6 Biglaw law firms, 4 have WestlawNext (although one, at present, is only making it available to firm librarians — see comments below) and 2 do not.

Of the 8 small/midsize firms, 5 have WestlawNext and 3 do not.

None of the public sector law libraries have WestlawNext.  The state agency reports that it might be added this summer.  I did find it a little ironic that the court libraries do not have WestlawNext — didn’t West get started by wooing the judiciary and treating judges extra special nice?

The comments I received were also very useful and I read many of them to my students, since they contain some great research tips and insights.

Here are a few of the comments:

I know that when firm librarians first saw the marketing materials, we were worried that the quality of search results would go down due to the one-box searching, but if anything the opposite has happened.  The result ranking is much better than it was previously, and you can see a lot more information before clicking into a document, which is great.

Our firm has a flat rate contract, so even though there is a cost for the original search ($50), the amount billed back to the client is significantly lower.  They shouldn’t be scared to use the resource due to the cost (at our firm anyway).  It’s in line with Lexis and the old version of Westlaw.  But of course, books are still cheaper.
Of course, they should still use good search practices so we’re not charging the client needlessly – searching broadly and then narrowing the focus, thinking before clicking into documents, checking before getting material from outside our pricing plan.  You can refer back to materials saved to a folder for a year, for free.  I’m saving a ton of material to folders.
The “price triggers” that incur costs: initial search, opening a document, clicking on the keycite materials. 
Our firm’s flat-rate contract doesn’t cover the PDF images of reporters – that’s the only place where you’re not warned before getting material outside of our contract.
We did a firm survey last year, and honestly, most of our attorneys start their research process on Google because it’s free.  Once they have useful information (like a case name or a statute or a law review article), they’ll go online and find all the related documents and secondary sources.  WestlawNext does a really good job of that, and the new format for KeyCite makes it easy to trace between material types. 
 
One more caveat: Keycite and Shepards both may say a case is good law when underlying statutes or cases have been invalidated (not always, but sometimes).  They don’t always catch it when a case has been invalidated by new legislation, as well.  Knowing how far to trust citator services is important.

Only librarians have been given permission to use WLN.  We will be offering mandatory class(es) on the product before attorneys are given passwords to access it.  We are aware that the law school students have been exposed to WLN & will likely expect to use it upon entering into the firm environment, so our window to get up-to-speed is fast approaching.Caveats:  Not everything has been loaded into WLN, so it could be frustrating to attorneys when prompted to transition in the middle of their research  to go to Westlaw. We’re also not sure if the costs will increase since clicking on any results keeps adding up the total.  I know we librarians have had conference call discussions about some of the quirky searching & results . . . .  Do I like it?  I had a trial ID & have not used it much since our contract went into effect in January.  I’m still “on the fence” about it, but realize it is the wave of the future in this Googlish society.

The federal courts do not have WestlawNext at this time, and my understanding is that while the Administrative Office in D.C. has discussed it with Thomson-Reuters, there is no plan to purchase it for the federal judiciary in the near future.

We are using it.  The attorneys really like it.  One thing I’ve learned about it is that you should never choose the hourly setting on WestlawNext.  Always use it in transactional mode since the nature of it promotes lots of browsing time.  Most law firms are turning off the hourly feature and forcing transactional mode, but if not it can wreak havoc with your flat-rate contract client allocation.

My advice for students:  Know how much the search costs are before you do it.  And always call the research attorneys — they know their tool better than any of us ever will.

We aren’t using it in the [state] Judicial Branch.  It’s way too expensive and we can’t afford it!  And if Westlaw itself becomes too expensive for us we may be forced to use just one service.  Since Lexis has the official reporting contract, we must have access to them.

I see other problems besides cost for WestlawNext in law firms.  To oversimplify: Google on new steroids represents WestlawNext’s research model. That model shows remarkable detachment from application to real-life research problems in law firms.  The stock examples used in WestlawNext’s demos fit TR’s marketing well enough, but I could not translate them into everyday, online research done in law firms. I also see evidence of algorithmic anomalies – possibly widespread – that have only begun to be explored.

We have been using WLN for the past year.  We hopped on the band wagon pretty early due to a demo seen here by our litigation partners.  The litigation attorneys like it a lot.  Power users of regular Westlaw have a big learning curve so do not like it quite as much.  It is great, however, for researching an area you may be unfamiliar with since it will give you the most relevant cases up front.  Our attys like this feature.  The attys also like the cost..they can figure out how much their research will cost them before going in since a search runs about $65
and then you can open as many docs as you want until you hit your research budget ($15/doc. or so).  It relieves some the pressure they feel when going in.  I think it is here to stay.  Even [after] I have cancelled Lexis access here, cut my print budget and staffing, the WLN contract was added without blinking an eye. . . .

We require everyone to be trained first on regular Westlaw. We will then train them on WestlawNext.  There a cost pitfalls with both.  Searching is cheaper and broader with WestlawNext, but if you want to look at lots of documents, you will run up the costs. Initial searching Westlaw is probably narrower (have to select a database), but then the documents don’t cost additional to view.

I would recommend that students avoid WestlawNext like the plague until they have a solid grasp on doing research on their own.  You do not want to be dependant on an algorithm created by a corporation to be able to do an essential part of your job.
 
I think Next can be a valuable tool and time-saver for attorneys who understand what the algorithm is doing and what the resources are it is returning in the results, but I worry if students start learning how to research using Next, they will not be able to do any research when they leave school unless they are using, and paying a steep price for, Next.

The two main reasons [we don't have it] is that Westlaw would require us to have a separate contract for WestlawNext (we see this as paying for Westlaw twice), and WestlawNext does not have all of Westlaw’s content. . . .

Though honestly we haven’t embraced it completely and probably won’t until West tells us they are pulling the plug on classic.  I think it is a good product.  I like the $60.00 search and the left-hand screen that guides you to your hits.  The biggest issue is the pricing per document.  Those clicks just add up.  I am planning on asking our summer assoc. class if they are using Classic or NEXT, then based on the response, the rep. will concentrate on one or the other for the orientation. It will be interesting to see where the product stands with this first summer class who have potentially been using it at school.

A dozen federal courts have been selected to participate in a pilot program in which the federal judiciary and the Government Printing Office are partnering to provide free public access to court opinions through the GPO’s FDSys system.

The one-year pilot project was approved by the Judicial Conference in March 2010, and the GPO received approval from the Joint Committee on Printing – often referred to as the oldest joint committee of the Congress – in February 2011.

When fully implemented later this year, the pilot will include two courts of appeals, seven district courts, and three bankruptcy courts. In March, the Judicial Conference approved expansion of the pilot to include up to 30 additional courts.

The judiciary continually has sought ways to enhance public access to court opinions. Free access to opinions in all federal courts is currently available via the judiciary’s Public Access to Court Electronic Records service (PACER).

Building on that success, staff from the Administrative Office of the U.S. Courts met with GPO management to explore making opinions even more accessible. Fdsys can provide the public with a robust search engine that can search common threads across opinions and courts.

The initial 12 participating courts are the U.S. Courts of Appeals for the Second and Eighth Circuits; the U.S. district courts for the Districts of Minnesota, Rhode Island, Maryland, Idaho, and Kansas, the Northern District of New York, and the Northern District of Alabama; and the U.S. bankruptcy courts for the District of Maine, the Southern District of Florida, and the Southern District of New York.
